Terms of Service

The agreement between you and us when you use ExactUpscale or buy ExactUpscale Pro. ExactUpscale is an Aurora Ivy product.

1. Who we are

ExactUpscale is operated by Michael Munz, trading as Aurora Ivy, Kasernenstr. 1, 71272 Renningen, Germany. Contact: contact@aurora-ivy.tech. Full legal details are in the Impressum.

2. The product

ExactUpscale is a desktop application that enlarges images to the exact pixel size you request. It runs on your device. Your photos are processed locally and are not uploaded to us. The software is provided as-is; see the EULA for the license terms.

4. Purchases, price, and payment

Prices are shown on the website at the time of purchase and include applicable VAT where required. Payments are handled by our merchant of record (Lemon Squeezy), who is the seller of record for the payment, invoices, VAT, and card processing. Their terms apply to the checkout and payment.

5. Subscriptions

A Pro subscription renews automatically at the billing period you choose (monthly or yearly) until cancelled. You can cancel at any time through the link in your purchase email or the merchant's customer portal; the subscription stays active until the end of the paid period. A subscription includes updates and new versions while it is active.

6. Lifetime license

A lifetime (one-time) license covers the current major version at the time of purchase, plus minor updates and bug fixes for that version. It does not include future major versions; those require a separate license or upgrade.

7. Refunds

Please see the Right of Withdrawal & Refund Policy. In short: once a license key has been issued there is no withdrawal refund, except where the product is defective or not as described.

8. Acceptable use

You may not reverse engineer, redistribute, resell, or sublicense the software except as allowed by law or the EULA, or use it to infringe the rights of others. You are responsible for the images you process and for having the rights to them.

9. Intellectual property

The software, its models, branding, and documentation are owned by Aurora Ivy and its licensors and are protected by copyright and other laws. The EULA and the licenses of the open-source components (see NOTICE) govern your rights.

10. Warranty and liability

To the maximum extent permitted by law, the software is provided without warranty of any kind, and our liability for any claims is limited to the amount you paid for the product. Nothing in these terms limits liability that cannot be limited by law, including for intent, gross negligence, or personal injury. Statutory consumer rights remain unaffected.

11. Changes

We may update these terms; the version in effect at the time of your purchase applies. Material changes will be posted on this page.

12. Governing law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protections of your country of residence continue to apply. The European Commission's ODR platform was discontinued on 20 July 2025; we are not obliged to participate in consumer arbitration.
