End User License Agreement (EULA)

The license terms for the ExactUpscale desktop application. ExactUpscale is an Aurora Ivy product.

1. License grant

Subject to these terms, Aurora Ivy grants you a non-exclusive, non-transferable license to install and use ExactUpscale on your own devices. Two license types exist: the free version and ExactUpscale Pro.

2. Free version

• For personal, non-commercial use.
• Limited to single images, up to 2K on the long side, and the Fast model.
• No time limit. You may use it to evaluate the product before buying Pro.

3. ExactUpscale Pro

Pro requires a valid license key and removes the free limits (any resolution, the Max model, batch processing) and permits commercial use. Pro is licensed in one of two ways:

• Subscription (monthly or yearly): valid while the subscription is active. It includes updates and new major versions released during the subscription period. If the subscription ends, the Pro features stop until it is renewed.
• Lifetime (one-time) license: valid for the current major version at the time of purchase, including minor updates and bug fixes for that version. It does not include future major versions. A new major version requires a separate license or upgrade.

4. License key and version scope

A license key is personal to you and encodes the plan and the version it covers. The software checks this when you activate. A lifetime key for one major version will not activate a later major version; a subscription key remains valid for new versions while the subscription is active. You may not share, sell, or transfer your key.

5. Restrictions

Except where allowed by law, you may not: reverse engineer, decompile, or disassemble the software; redistribute, resell, sublicense, or rent it; remove or alter notices; or use it to infringe the rights of others. The open-source components are governed by their own licenses (see NOTICE).

6. Intellectual property

The software, its models, and all related materials are owned by Aurora Ivy and its licensors and are protected by copyright and other laws. This agreement does not transfer ownership; it only grants the license described above.

7. Your images

You keep all rights to the images you process. Processing happens locally on your device; your images are not uploaded to us. You are responsible for having the rights to the images you process and for the results you produce.

8. Warranty disclaimer

To the maximum extent permitted by law, the software is provided "as is" without warranty of any kind, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that it will meet your requirements or be uninterrupted or error-free.

9. Termination

This license ends if you breach it. On termination you must stop using the software and delete all copies and license keys. Sections on intellectual property, warranty, and liability survive termination.
